Leaseholders

Leaseholder is a property owner who owns individual apartments in Winnals Park under leasehold. Some leaseholders may own more than one apartment. Leaseholders’ rights and responsibilities are delineated in lease, a legal document between Winnals Park freeholder and individual property owner. There are some variations between leases, but they are minor, and usually relate to the length of the lease, and possibly ownership of garage. and responsibilities related to that. Some leaseholders are owner occupiers, and some leaseholders buy the property to rent to tenants. Tenants as well as leaseholders are obliged to abide by the lease rules and conditions. Members meet yearly, for Annual General Meeting - they meet directors, inspect accounts and hear annual report from the Board of Directors.

Freehold

Freehold of Winnals Park is owned by the company called WINNALS PARK HAYWARDS HEATH RESIDENTS COMPANY LIMITED. The company is a private company limited by guarantee. It was incorporated on 21 May 1991. The company number is 2613052. Accounts are public and available through Company Register. Leaseholders are members, (not shareholders), one for each individual apartment. Company is run according to its articles of association agreed by the members, directors and the company secretary, and must comply with all relevant laws and regulations of the land (like Companies Act 2006). Directors is chosen from between members, and constitute a Board of Directors. Members meet yearly, for Annual General Meeting - they meet directors, inspect accounts and hear annual report from the Board of Directors.

Board of Directors

Directors that sit on the Board of Directors are chosen from amongst leaseholders / members of Winnals Park Haywards Heath Company Ltd. Board of Director’s  powers, duties, and responsibilities are determined jointly by government regulations  and the organisation’s own articles of association. In practice, our Board of Directors makes decisions about investments, improvements, and maintenance of grounds and common areas of Winnals Park (anything from gutters, roofs, parking and gardens). Directorships are unpaid. Directors meet regularly at the board meetings, which are minuted by attending Managing Agent or one of the Directors present.

Property Management Company

Property management company is responsible for day-to-day running of the estate. The duties and responsibilities of our PMC are enclosed in the contract between Graves Son & Pilcher LLP and Winnals Park Haywards Heath Residents Company Limited. Winnals Park appointed Graves Son and Pilcher LLP in 2022 as their property management company. Graves Son and Pilcher duties include but are not limited to the following: Collection of service charge and ground rent; Management of contractors; Handling solicitors’ enquiries on the sale of individual properties; Engaging and management of maintenance contracts and repairs; Purchase and administration of Block Building and Public Liability Insurance and handling of communal claims; Dealing with Breaches of Lease; Assistance with Preparation of Year End Accounts; Service Charge and Ground Rent invoicing and arrears collection; Attendance of meetings and taking minutes; Regular property visits and inspections. Number of these tasks is shared with Board of Directors.
